As a consumer or business person, you may be more familiar with the work of the Federal Trade Commission than you think.
The FTC deals with issues that touch the economic life of every American. It is the only federal agency with both consumer protection and competition jurisdiction in broad sectors of the economy. The FTC pursues vigorous and effective law enforcement; advances consumers’ interests by sharing its expertise with federal and state legislatures and U.S. and international government agencies; develops policy and research tools through hearings, workshops, and conferences; and creates practical and plain-language educational programs for consumers and businesses in a global marketplace with constantly changing technologies.
When the FTC was created in 1914, its purpose was to prevent unfair methods of competition in commerce as part of the battle to “bust the trusts.” Over the years, Congress passed additional laws giving the agency greater authority to police anticompetitive practices. In 1938, Congress passed a broad prohibition against “unfair and deceptive acts or practices.” Since then, the Commission also has been directed to administer a wide variety of other consumer protection laws, including the Telemarketing Sales Rule, the Pay-Per-Call Rule and the Equal Credit Opportunity Act. In 1975, Congress gave the FTC the authority to adopt industry-wide trade regulation rules. The FTC’s work is performed by the Bureaus of Consumer Protection, Competition and Economics. That work is aided by the Office of General Counsel and seven regional offices.

The Commission is headed by five Commissioners, nominated by the President and confirmed by the Senate, each serving a seven-year term. The President chooses one Commissioner to act as Chairman. No more than three Commissioners can be of the same political party.

Jon Leibowitz, Chairman
Jon Leibowitz was designated to serve as Chairman of the Federal Trade Commission on March 2, 2009, by President Barack H. Obama. Leibowitz was previously sworn in as a Commissioner in September 3, 2004, following his nomination by the President and confirmation by the U.S. Senate.
In joining the Commission, Leibowitz resumed a long career of public service. He was the Democratic chief counsel and staff director for the U.S. Senate Antitrust Subcommittee from 1997 to 2000, where he focused on competition policy and telecommunications matters. He served as chief counsel and staff director for the Senate Subcommittee on Terrorism and Technology from 1995 to 1996 and the Senate Subcommittee on Juvenile Justice from 1991 to 1994. In addition, he served as chief counsel to Senator Herb Kohl from 1989 to 2000. Leibowitz worked for Senator Paul Simon from 1986 to 1987. In the private sector, Leibowitz served most recently as vice president for congressional affairs for the Motion Picture Association of America – from 2000 to 2004 – and worked as an attorney in private practice in Washington from 1984 to 1986.
A Phi Beta Kappa graduate of the University of Wisconsin with a B.A. in American History (1980), Leibowitz graduated from the New York University School of Law in 1984. He is a member of the District of Columbia Bar, and has co-authored amicus briefs before the U.S. Supreme Court on issues ranging from gun control to the census.
He lives in Bethesda with his wife, Ruth Marcus, and his two daughters, Emma and Julia.

Julie Brill, Commissioner
Julie Brill was sworn in as a Commissioner of the Federal Trade Commission April 6, 2010, to a term that expires on September 25, 2016.
Before she became a Commissioner, Brill was the Senior Deputy Attorney General and Chief of Consumer Protection and Antitrust for the North Carolina Department of Justice, a position she held since February 2009. Brill has also been a Lecturer-in-Law at Columbia University’s School of Law. Prior to her move to the North Carolina Department of Justice, Brill was an Assistant Attorney General for Consumer Protection and Antitrust for the State of Vermont for over 20 years, from 1988 to 2009.
Brill has received several national awards for her work protecting consumers. She has testified before Congress, published numerous articles, and served on many national expert panels focused on consumer protection issues such as pharmaceuticals, privacy, credit reporting, data security breaches, and tobacco. Brill has also served as a Vice-Chair of the Consumer Protection Committee of the Antitrust Section of the American Bar Association.
Prior to her career in law enforcement, Brill was an associate at Paul, Weiss, Rifkind, Wharton & Garrison in New York from 1987 to 1988. She clerked for Vermont Federal District Court Judge Franklin S. Billings, Jr. From 1985 to 1986. Brill graduated, magna cum laude, from Princeton University, and from New York University School of Law, where she had a Root-Tilden Scholarship for her commitment to public service.
Brill is married to Mark Miller, and has two sons, Zachary and Noah.

William E. Kovacic, Commissioner
William E. Kovacic has served on the Federal Trade Commission since January 2006, and served as Chairman from March 2008 until March 2009. He has also served, since January 2009, as Vice Chair for Outreach of the International Competition Network.
Before he became a Commissioner, Kovacic was the FTC’s General Counsel from 2001 through 2004, and also worked for the Commission from 1979 until 1983, initially in the Bureau of Competition’s Planning Office and later as an attorney advisor to former Commissioner George W. Douglas.
Kovacic was the E.K. Gubin Professor of Government Contracts Law at George Washington University Law School, where he began teaching in 1999.  He had taught at the George Mason University School of Law since 1986, after practicing antitrust and government contracts law for three years at Bryan Cave’s Washington, DC, office. Earlier in his career, Kovacic spent one year on the majority staff of the U.S. Senate Judiciary Committee’s Antitrust and Monopoly Subcommittee.
Beginning in 1992, Kovacic was an adviser on antitrust and consumer protection issues to the governments of Armenia, Benin, Egypt, El Salvador, Georgia, Guyana, Indonesia, Kazakhstan, Mongolia, Morocco, Nepal, Panama, Russia, Ukraine, Vietnam, and Zimbabwe.
Kovacic received a bachelor degree from Princeton University in 1974 and a law degree from Columbia University in 1978. He and his wife, Kathryn Fenton, reside in Virginia.

Edith Ramirez, Commissioner
Edith Ramirez was sworn in as a Commissioner of the Federal Trade Commission on April 5, 2010, to a term that expires on September 25, 2015.
Prior to joining the Commission, Ramirez was a partner in the Los Angeles office of Quinn Emanuel Urquhart & Sullivan, LLP, where she handled a broad range of complex business litigation, including successfully representing clients in intellectual property, antitrust, unfair competition, and Lanham Act matters. She also has extensive appellate litigation experience.
From 1993-1996, Ramirez was an associate at Gibson, Dunn & Crutcher, LLP in Los Angeles. She clerked for the Hon. Alfred T. Goodwin in the United States Court of Appeals for the Ninth Circuit from 1992-1993.
Throughout her career, Ramirez has been active in a variety of professional and community activities. Most recently, she served as the Vice President on the Board of Commissioners for the Los Angeles Department of Water and Power, the nation’s largest municipal utility.
Ramirez graduated from Harvard Law School cum laude (1992), where she served as an editor of the Harvard Law Review, and holds an A.B. in History magna cum laude from Harvard University (1989).
Ramirez is a native of Southern California.

J. Thomas Rosch, Commissioner
J. Thomas Rosch was sworn in as a Commissioner of the Federal Trade Commission January 5, 2006, to a term that expires in September 2012.
Rosch joined the FTC from the San Francisco office of Latham & Watkins, where he was the former managing partner and most recently a partner, working in the firm’s antitrust and trade practices group. Rosch served as chair of the American Bar Association’s Antitrust Section in 1990, and he has chaired the California Bar Association’s Antitrust Section. He served as the FTC’s Bureau of Consumer Protection director from 1973 to 1975, and in 1989 was a member of the Special Committee to Study the Role of the FTC.
Nationally regarded for his antitrust and trade regulation law expertise, and as a Fellow of the American College of Trial Lawyers for more than 20 years, he has been lead counsel in more than 100 federal and state court antitrust cases and has more than 40 years experience before the Bar. In 2003, Rosch was honored as Antitrust Lawyer of the Year by the California State Bar Antitrust Section. He obtained his LLB from Harvard University in 1965 and was a Knox Fellow at Cambridge in 1962.
Rosch is married with two children and four grandchildren.

It issues news releases on all significant Commission actions, responds to reporters’ inquiries and arranges television, radio, and print interviews for FTC officials. The Office of Congressional Relations works closely with members of Congress and their staffs. The Executive Director is the FTC’s chief operating officer and manager, responsible for such matters as administrative services, financial management, procurement, human resources management, information and technology management, as well as overall FTC program and policy execution. The Executive Director directs the agency’s reauthorization and appropriations efforts, and works closely with the bureaus on strategic planning and assessing the management and resource implications of any proposed action.

The Office of Inspector General acts as the “agency cop” and as such is responsible for the detection and prevention of waste, fraud and abuse in agency programs. The Inspector General conducts audits and investigates allegations of wrongdoing within the agency. The Bureau of Economics helps the FTC evaluate the economic impact of its actions. To do so, the Bureau provides economic analysis and support to antitrust and consumer protection investigations and rulemakings. It also analyzes the impact of government regulation on competition and consumers and provides Congress, the Executive Branch and the public with economic analysis of market processes as they relate to antitrust, consumer protection, and regulation.

Bureau of Consumer Protection‘s mandate is to protect consumers against unfair, deceptive or fraudulent practices. The Bureau enforces a variety of consumer protection laws enacted by Congress, as well as trade regulation rules issued by the Commission. Its actions include individual company and industry-wide investigations, administrative and federal court litigation, rulemaking proceedings, and consumer and business education. In addition, the Bureau contributes to the Commission’s on-going efforts to inform Congress and other government entities of the impact that proposed actions could have on consumers.

The Regional Offices cover seven geographic areas. The regional offices work with the Bureaus of Competition and Consumer Protection to conduct investigations and litigation, provide advice to state and local officials on the competitive implications of proposed actions, recommend cases, provide local outreach services to consumers and businesspersons, and coordinate activities with local, state, and regional authorities. FTC regional offices frequently sponsor conferences for small businesses, local authorities, and consumer groups.
